The planned agreement between the EU and the U.S. on the exchange of data on bank operations, provides that it also would include information about the transactions performed within a single country. The message provided the Brussels studio, radio station WDR / NDR, which states that reached a draft agreement.
Under the planned agreement with European Union finance ministry and the U.S. could jointly decide which banks would have to transmit data to the United States. In this situation, authorities would consult not only in the collections of the International Association of SWIFT, but also information on such transfers or payments related to rental housing.
Quoted by the WDR / NDR Peter Schaar (German Federal Data Protection of personal data) announced that turning to the reported data and payment information purely local can not be justified in any way. Therefore, the data transfer performed within the borders of one country should be excluded from the set of available information. MEP Alexander Alvaro notes that still has no findings as to the time erasing the data. In addition, Alvaro doubts whether such information may be transferred to third countries which do not meet European standards of data protection.
MEP from the Green Party, John Albert, in turn, suggests that the talks were suspended for the time being - so he could participate in the European Parliament. The next date for their resumption would be in January next year, when the Treaty of Lisbon enters into force. Albrecht, in agreement lacks a clear definition of terrorism. It must be ensured that the data will be exchanged only if it actually will be linked to terrorist activities. Ideally, the judge decided, when the data can be transmitted, and when not.
SWIFT network collects data on transfers of more than 9,000 banks operating in over 200 countries. Autumn 2007, the association announced that the end of 2009 is going to move a data center in Switzerland. After opening this center, all information sent between financial institutions in Europe will remain on the Old Continent, and consequently no longer be covered by the regulations for the confiscation issued by the U.S. Ministry of Finance (which relate to servers that are currently in the U.S.). This issue, both parties want to resolve with the transitional arrangements for the transfer of data. Negotiations are currently underway on the interim agreement, as submitted by the Presidency of the European Union in 2010 are expected to begin talks on long-term agreement, which will also involved the European Parliament.
