'Monkey Selfie' Appellate Ruling Finds Animals Can't File Copyright Suits

Ever since 2015 Slater has been in a battle with PETA who clearly think they're on some sort of moral crusade to stop people from depriving this poor monkey of royalties. "In 2011, a wildlife photographer, David Slater, left his camera unattended in the reserve".

Slater argued that he had engineered the photographs in 2008 by travelling to an Indonesia jungle, spending time with the monkeys to gain their trust, and deliberately making his camera accessible to the animals to take photographs.

People for the Ethical Treatment of Animals sought financial control of the photos to benefit the monkey.

"After seeing the proverbial writing on the wall at oral argument, PETA and Appellees filed a motion asking this court to dismiss Naruto's appeal and to vacate the district court's adverse judgment, representing that PETA's claims against Slater had been settled".

We feel compelled to note that PETA's deficiencies in this regard go far beyond its failure to plead a significant relationship with Naruto. Bush, said that Congress must explicitly state inside the law that animals can sue. The judges said PETA was using the animal as an "unwitting pawn" for their agenda.

Slater later included the monkey selfie photos in a book he published and that's when things took an unexpected turn. Nonetheless, we conclude that this monkey - and all animals, since they are not human - lacks statutory standing under the Copyright Act.

PETA and Mr Slater reached a deal in September outside of court where he agreed to donate 25% of the revenue he receives from the selfie to charities that protect crested macaques.

They asked the 9th Circuit to dismiss the case and throw out Orrick's decision.

The judges said a decision in this "developing area of the law" would be useful to guide lower courts in the future.

It wasn't immediately clear how or if Monday's ruling would affect the settlement.

"Allowing next-friend standing on behalf of animals allows lawyers (as in Cetacean) and various interest groups (as here) to bring suit on behalf of those animals or objects with no means or manner to ensure the animals' interests are truly being expressed or advanced", Smith writes.
